WALNUT CREEK, CALIF., March 16, 2017 – Lawyers in Archer Norris’s Cannabis Practice Group scored a big win for their clients in Calaveras County, successfully challenging eight misleading ballot arguments that had been submitted in favor of Measure B, a voter initiative seeking a County-wide ban on commercial cannabis cultivation. The challenged ballot arguments would have spread misinformation on a variety of topics associated with the initiative, including the amount of federal funding available for enforcement and the effect of the cannabis industry on local real estate values.
The Cannabis Practice Group argued that eight of the proponents’ ballot arguments were unlawfully misleading. Last week, the Calaveras County Superior Court agreed on all eight points and granted a Petition for Writ of Mandate ruling that these ballot arguments must corrected or removed from County election materials.
Adrian Lambie, a Senior Associate who co-authored and argued the Writ Petition with partner and Cannabis Practice Group leader Jasun Molinelli, stated “this is an important win, not just for our client, but for the people of Calaveras County, who deserve to make their decision about Measure B based on complete and accurate information. We are glad the Court agreed.”
The case is Bowerman v. Turner, et al., Calaveras County Superior Court Case No. 17CV42208.
