Problem
The owner-builder of a 5500 sq. ft. custom single-family home in Fair Oaks (Sacramento) sued our client, CA Construction, for construction defect, breach of contract, negligence and violations of Business and Professions codes related to contractor licensure issues. Plaintiff asked the jury to return a verdict in their favor and award damages of $750,000.00.
Solution
Todd Jones and Greg Federico took the case to trial. After two and a half weeks, a Sacramento jury returned a defense verdict in favor of our client on all three causes of action.
Result
As the prevailing party, our client will seek attorneys’ fees and costs allowed per contract, plus additional costs based on an expired $25,000 CCP §998 Offer to Compromise. As Todd Jones remarked, “It was a whole team victory and every person in the Sacramento office contributed to the win for our client.”
