Confidentiality agreements are hard to enforce, no matter how “iron-clad” the agreement. In a recent Daily Journal article, Archer Norris attorney Carol Gefis discusses “to what extent allegations of misconduct can be kept quiet through a confidentiality agreement.” Recent allegations brought against Republican presidential candidate Herman Cain prove to be a great case study for the current legal system and a chance to revisit this issue, even though there are no “easy answers.
