The Bakersfield Californian article, "Judge sides with Canyons developer in environmental lawsuit," reports on a recent ruling about a nearly 900-acre Kern River housing development. The court ruled the Environmental Impact Report was adequate, after the Sierra Club challenged its approval.
Archer Norris attorneys Peter McGaw and Ed Shaffer scored a major victory for our developer client in a contentious battle with the Sierra Club over approval of a 1300-home project in the City of Bakersfield. Besides disagreeing with challenges to the Environmental Impact Report, the court ruled that Sierra Club was barred from bringing its lawsuit because it had not properly alerted the City Council to remaining objections - referred to as exhaustion of administrative remedies. "The judge ruled against the Sierra Club on all points," commented Ed Shaffer.
