The On Call Trial Counsel team of KC Ward and Keith Gillette obtained a favorable $8 million verdict on behalf of our client in the re-trial that cut down by more than half the previous $20.7 million verdict.
Our client, a national general contractor of an office park project, contracted with a subcontractor to provide the metal decking surface upon which other trades could work. The plaintiff, a foreman for the metal decking company, was working on this surface when he lost his balance and fell to the floor below. He is now disabled. In the first trial, the plaintiff argued that the contractor was negligent and the jury awarded $20.8 million. Defendants appealed and a new trial was ordered.
Archer Norris was hired after the new trial was ordered. Our trial arguments emphasized that our client had relied on the expertise of the subcontractor. The jury awarded a net verdict of $8 million. Our client's share of that verdict was $1.6 million.
