Intellectual property victory against leading U.S. nutrition company in bet-the-farm case

Problem

Client Compass Product Design found itself in a difficult situation. Compass had contracted with one of the nation’s largest home health and nutrition companies to design a home air purifier using a new, patented filter technology. After paying Compass several hundred thousand dollars, and with the project nearly completed, the company terminated the contract. The company then sought to recover all of the monies paid to Compass, relying upon a contract term it had surreptitiously inserted into the contract.

Solution

The problem was that a loss to Compass would jeopardize its ability to remain in business. With the help of a very determined client, Archer Norris attorneys counterclaimed for the amounts Compass was owed, asserting both breach of contract and business tort claims.

Result

Compass was awarded outstanding contract payments, project incentive bonuses, and attorneys’ fees totaling nearly $175,000.
