Archer Norris Represents Former Jamba Juice CEO in Severance Negotiations

Issue:

André Hill and a team that included Kim Scala, Virginia Peiser and Nöel Caughman were instrumental in negotiating the separation agreement and amicable departure of former Jamba Juice CEO Paul Clayton.

Strategy:

As reported in the San Francisco Business Times, Clayton will be paid one year’s salary ($525,000) in severance, COBRA coverage for his benefits, and will be fully vested in stock options and grants of restricted company stock in connection with the severance agreement. The tax implications were challenging, but ultimately our team negotiated an equitable settlement with the struggling Jamba Juice. The result further enhances our firm’s reputation in the business community as accomplished and fair negotiators.
