Specializing in litigation, Daniel J. McKenzie is an associate working across a broad range of matters including construction defect/delay (representing developers, sub-contractors and plaintiffs), business litigation, real estate litigation, personal injury claims, and collections matters.  Dan has extensive experience defending and prosecuting all aspects of such cases, from pre-filing preparation through discovery, all the way to trial and judgment.

Dan has experience successfully litigating these and other types of claims in civil court, as well as in front of arbitrators and administrative hearing bodies.

In addition to taking numerous depositions, Dan frequently writes and argues successful motions in front of trial courts throughout Southern California. He also has vast experience in all aspects of the discovery process, settlement negotiations, and trial preparation.

Experience on Both Sides of the Litigation Process

In addition to his defense experience, he has also litigated several catastrophic personal injury claims to successful conclusion from the plaintiff’s side. His accomplishments include negotiating and drafting a seven-figure policy limit settlement in favor of a personal injury plaintiff against a business establishment on the basis of the little-known Drug Dealer Liability Act. 

Dan’s experience on both sides of the litigation process helps him to view difficult issues from all sides in order to devise the most effective resolution to any issue at hand.

Dan McKenzie’s representative matters include:

  • Premises Liability Personal Injury Defense - Plaintiff (young child) sued Defendants premises owner and lessee for personal injuries sustained when pole allegedly belonging to lessee impaled Plaintiff’s arm.  Dan drafted victorious summary judgment motion on behalf of Defendant lessee on the basis that Plaintiff failed to provide evidence that the lessee breached a duty to Plaintiff. 
  • Construction Defect - After obtaining several thousand dollars in discovery sanctions for Plaintiff homeowner’s abuse of the discovery process, brought successful motion in limine precluding Plaintiff from presenting expert testimony.  As a result, on the day trial was to begin, case settled for less than 10% of the pre-trial demand. 
  • Catastrophic Personal Injury - Client left in persistent vegetative state as a result of auto collision with intoxicated driver. Driver implicated business establishment where he claimed to have purchased illegal drugs from worker. Dan negotiated and drafted a seven-figure policy limit settlement in favor of a plaintiff against the business establishment on the basis of the little-known Drug Dealer Liability Act.
