Dana Duncan has over 20 years experience in litigating and participating in the trial of medical malpractice, personal injury, toxic tort, products liability and class action cases. For the last twelve years she has primarily focused on construction defect litigation where she has successfully litigated through trial. 

Informed Focus in Construction Litigation

Her construction defect practice includes both commercial and residential construction matters in which she represents developers, general contractors, product manufactures, material suppliers and subcontractors in litigation throughout California. Of particular interest to Ms. Duncan is the defense of window designers, manufacturers and window suppliers. On behalf of a window manufacturing client she litigated the case through trial with the jury returning a 12-0 defense verdict in favor of her client.

Recognition of the Costs

Litigation is not only financially costly, but in many instances the client experiences emotional turmoil, and the cost of lost time associated with suing and/or being sued. Therefore, in representing her clients, she utilizes early dispute resolution through mediation or other means when appropriate and is committed to keeping her client’s informed throughout the litigation process. “We are a team from retention through resolution.”

In addition to litigation, she has volunteered her time as a mediator of homeowner disputes and speaks before various trade organizations.
