Advocate, litigator, negotiator, and legal advisor, Mark Furuya applies his extensive legal experience to a wide arena, including business, real estate, employment, entertainment, and construction.
Particularly adept at start-up business formation, negotiating and executing transactions, and related issues, Mark focuses on helping businesses grow and prosper. Familiar with the business challenges inherent to litigation, he uses litigation avoidance techniques whenever possible for his entrepreneurial clients. Strategies include regulatory and corporate compliance, review of employee handbooks and policies, and negotiation and drafting of contractual agreements.
Whether acting as general counsel or working with in-house counsel, Mark focuses on directing, managing, and litigating contractual and tort-related litigation matters involving public and private businesses, public agencies, and municipalities. He has represented entities in real estate and entertainment matters as well. Specific litigation experience includes first and second chair in bench and jury trials, Federal, State, Bankruptcy, and Appeals cases.
Prior to joining Archer Norris, Mark was Of Counsel at the Kinaga Law Firm. Previously, he was an associate at Sabaitis O’Callaghan where he managed and represented all aspects of client cases. Mark’s previous experience provides an invaluable knowledge of the local courts and the Los Angeles legal community.
Mark Furuya’s representative matters include:
Business Transactions – Drafted corporate start-up/formation documents, including Articles of Incorporation, By-Laws, and Capital Investment Agreements.
Development Projects – Negotiated and drafted agreements related to multi-million dollar real estate development projects for clients, including obtaining the proper permitting and licensing from applicable municipalities.
Development Projects – Streamlined development projects for a real estate management company by creating clear separation between subsidiaries, and in turn ensuring separate corporate entities.
Employee Handbooks – Revamped employment handbooks, policies and contracts for construction and landscaping companies, eliminating potential wage/hour and discrimination claims.
Construction Defect – Managed and resolved complex construction defect claims involving municipalities and multi-million dollar housing projects.
Entertainment – Successfully defended and resolved a multi-million dollar breach of contract claim by a filmmaker against an entertainment media company by filing a counterclaim against the filmmaker and eventually settling for a nominal amount.
Unlawful Detainer/Breach of Contract – Successfully resolved unlawful detainer/breach of contract matters on multiple-unit buildings in Class A commercial office space and industrial units.
International Jurisdictions – Obtained Court of Appeals judgment in favor of client, reversing trial court on international jurisdictional issues, thereby transferring case to Japan where the client ultimately prevailed in its case.
Wage/Hour and Discrimination – Successfully negotiated and settled discrimination and wage/hour claims in excess of millions.
Wage/Hour and Discrimination – Obtained a defense verdict on a motion for class certification on a wage and hour claim.
